Vi Impartial Due Process Hearings

Parents who disagree with a school districts decisions regarding their childs eligibility and/or placement under the IDEA also have a federal right to request a due process mediation and/or hearing. Train School Staff To Treat Your Childs Diabetes

You in conjunction with the school will identify the personnel that will be managing your childs Diabetes. This person needs to:

  • know how to test blood sugar levels and interpret the results
  • know how to measure and administer insulin,

Objectives/goals Of This Plan

Diabetes can cause blood glucose levels to be too high or too low, both of which affect the students ability to learn as well as seriously endangering the students health both immediately and in the long term. The goal of this plan is to provide the special education and/or related aids and services needed to maintain blood glucose within this students target range, and to respond appropriately to levels outside of this range in accordance with the instructions provided by the students personal health care team.

Parents Role In The 504 Process

In addition to submitting a formal request for a 504 Plan and a cover letter to the school, a parent or guardian is responsible for providing the school with the following:

  • All materials and equipment necessary for T1D care tasks, including blood-glucose testing supplies and insulin administration .
  • The parent is responsible for the maintenance of the equipment and must provide instructions to ensure the proper disposal of materials. A separate logbook should be kept at school for the staff or student to record blood-glucose-test results.
  • Supplies to treat hypoglycemia, including a source of glucose and a glucagon emergency kit.
  • Information about T1D.
  • Emergency phone numbers for the parent and the students diabetes doctor so that the school can contact these individuals with T1D-related questions or during emergencies.
  • Information about the students meal and snack schedule. The parent should work with the school to coordinate this schedule with that of the rest of the class as much as possible. For young children, instructions should be given for when food is provided during school parties and other activities.

504 accommodations can also be requested through college. However, 504 rights and accommodations at the post-secondary level require self-advocacy.

A good 504 Plan takes planning to accommodate the individualized needs for a Type 1 Diabetic student. The schools 504 Coordinator will implement the plan but parents should take on the responsibility of managing the plan. Managing the plan means updating it as needed. A good plan adapts with a child or teen through transition years. Parents can also coach teens in understanding the 504 process to self-advocate in college for their legal rights.

Exercise And Physical Activity

5.1 The student shall be permitted to participate fully in physical education classes and team sports except as set out in the students DMMP.

5.2 Physical education instructors and sports coaches must have a copy of the emergency action plan and be able to recognize and assist with the treatment of low blood glucose levels.

5.3 Responsible school staff members will make sure that the students blood glucose meter, a quick-acting source of glucose, and water is always available at the site of physical education class and team sports practices and games.

What Steps Do I Need To Take To Apply

How To Create A 504 Plan For A Child With Diabetes

When I first heard the term 504 plan, I assumed it was the plan of action if your blood sugar if 500 mg/dL. Which it is not. But my type 1 diabetes diagnosis in 1986 left my family responsible for assembling an unofficial, ad hoc version of a care plan that worked for us and the school system the concept of a structured plan being in place was beyond us, even though the groundwork for these plans was put into place in the 1970s.

Despite growing up without a 504 Plan, I wanted to learn more about these smart plans to help protect students with diabetes.

What is a 504 plan?

A 504 plan is named for Section 504 of the Rehabilitation Act of 1973, which is a federal civil rights law that prohibits discrimination on the basis of disability. The plan itself is an outline for the actions taken by a school to ensure that a child with diabetes, or other health condition specified as a disability, is treated fairly. According to the American Diabetes Association, its a tool that can be used to make sure that students, parents/guardians, and school staff understand their responsibilities and to minimize misunderstandings. Its designed to help students with disabilities in public schools or publicly funded private schools create customized educational plans.

With so many variables in play for a child with diabetes, the need to minimize misunderstandings is important. .

Ive heard of a DMMP. But what exactly is that?

How do 504 Plans help?

Schools Role In The 504 Process

It is the responsibility of the school and its personnel to have an understanding of T1D and be trained in its management and in the treatment of T1D emergencies. Knowledgeable, trained school personnel are essential to a students safety and physical well-being when dealing with immediate health risks of high or low blood-glucose level. Furthermore, an individualized 504 Plan should be developed and signed by the school, the parent or guardian, and the childs T1D management care team. The 504 Plan should address the specific needs of the child and provide specific instructions related to the following:

  • Times/places for blood-glucose monitoring, including accommodations for testing and treating
  • Ensuring that staff members are trained in checking blood-glucose levels, recognizing and treating high and low blood-glucose symptoms, and administering both insulin and glucagon
  • Allowing the student to eat whenever and wherever necessary, including eating lunch at an appropriate time and allowing enough time to finish eating
  • Allowing extra trips to the bathroom or water fountain
  • Ensuring the students full participation in all sports, extracurricular activities and field trips, with the necessary care and/or supervision
  • Permitting extra absences for medical appointments and sick days when necessary, without penalty

How Will My Child Benefit From The 504 Plan

The 504 Plan will allow for every child with Type 1 to participate in school normally without ever being excluded from any activity, with the support of teachers, the schools medical team and the childs doctor. The students doctor will outline a specific diabetes management plan for the school to be followed during school hours. In short, the 504 Plan makes certain that everyone is on the same page in order to provide the safest and most enjoyable experience possible throughout your childs education!

Checklist: Who May Administer Insulin In Californias Schools Pursuant To An Iep Or A Section 504 Plan

504 Plans for Type 1 Diabetics

Business and Professions Code Section 2725 and the California Code of Regulations, Title 5, Section 604 authorize the following types of persons to administer insulin in Californias public schools pursuant to a Section 504 Plan or an IEP:

  • Self administration, with authorization of the students licensed health care provide and parent/guardian
  • School nurse or school physician employed by the LEA
  • Appropriately licensed school employee who is supervised by a school physician, school nurse, or other appropriate individual
  • Contracted registered nurse or licensed vocational nurse from a private agency or registry, or by contract with a public health nurse employed by the local county health department
  • Parent/guardian who so elect
  • Parent/guardian designee, if parent/guardian so elects, who shall be a volunteer who is not an employee of the LEA and
  • Unlicensed voluntary school employee with appropriate training, but only in emergencies as defined by Section 2727 of the Business and Professions Code .3 When no expressly authorized person is available under categories 2-4, supra, federal law – the Section 504 Plan or the IEP – must still be honored and implemented. Thus, a category #8 is available under federal law:
  • Voluntary school employee who is unlicensed but who has been adequately trained to administer insulin pursuant to the students treating physicians orders as required by the Section 504 Plan or the IEP.

    Recognizing Low Blood Sugars

    All school staff in charge of your child should be trained on how to recognize these low glucose symptoms:

    • shakiness
    • irritability
    • saying things that do not make sense

    If any of these symptoms are present, the school nurse/school personnel needs to test your childs glucose levels, and give carbs to place your child in range if they are below 70 mg/dL.

    Field Trips And Extracurricular Activities

    Part 2 Customizing the 504 Plan for Your Child

    8.1 The student will be permitted to participate in all school-sponsored field trips and extracurricular activities without restriction and with all of the accommodations and modifications, including necessary supervision by identified school personnel, set out in this Plan. The students parent/guardian will not be required to accompany the student on field trips or any other school activity.

    8.2 The school nurse or TDP will be available on site at all school-sponsored field trips and extracurricular activities, will provide all usual aspects of diabetes care , and will make sure that the students diabetes supplies travel with the student.

    Do You Need An Iep Or A 504 Plan

    As a parent of a child with a medical condition, such as diabetes, you need to set in place everything in your power to keep your child safe, but that he/she is successful at the same time in school.

    For a child with Type 1 Diabetes, you need a 504 Plan for these school accommodations to take place.

    An IEP , is written for kids who have a severe mental health condition, low IQ, behavioral issues, or struggles severely with their academics.

    Diabetes is considered to be a disability due to the child/adolescent needing insulin 24/7, and they require to be under adult supervision in order to prevent severe impairment or death. Most of the kids fall into this category.

    S To Implementing A School Plan

    1. Ideally, you should contact the school before your child comes home from the hospital after diagnosis. Talk with the principal, your childs teachers and coaches stating your fears, concerns and hopes for your child in general and while in school. This will help and provide the school with a deeper sense of whats going on for you and your child.

    2. Try to arrange a general meeting for school personnel where you and someone from your healthcare team present a brief presentation on T1D in school age children. It should be a brief, basic review of the essentials of what T1D is and how it is generally managed. The end should focus on outlining your childs specific plan. Assure the school staff that you want to build a partnership between the childs diabetes care team and her school team.

    3. Before sending your child to school, make sure that you have prepared a School Diabetes Emergency kit that stays in the school nurses or administrators office. Minimally, the kit should include:
